1. Allgemein
Die vorliegenden Geschäftsbedingungen gelten für die unentgeltliche Nutzung der Software ARON zu Testzwecken. Entgegenstehende oder von diesen Geschäftsbedingungen abweichende Bedingungen des Kunden haben keine Geltung. Nebenabreden, Änderungen oder Ergänzungen bedürfen der Schriftform. Fraunhofer behält sich vor, die Software weiteren Kunden anzubieten.
Das ARON-Tool verwendet fogende Open-Source-Python-Biblotheken: pvlib (pvlib Dokumentation), pandas (pandas Hauptseite), numpy (numpy Hauptseite), matplotlib (matplotlib Hauptseite), SciPy (scipy Hauptseite), Tkinter (tkinter Hauptseite).
2. Nutzungsrechte
Fraunhofer räumt dem Kunden das einfache (nicht ausschließliche) und zeitlich beschränkte Recht ein, die in dieser Website näher bezeichnete Software ARON nach Maßgabe der nachfolgenden Bestimmungen nur zu Testzwecken unentgeltlich zu nutzen. Eine über die nachfolgenden Bestimmungen hinausgehende Rechtseinräumung ist mit der Überlassung der Software nicht verbunden. Die Fraunhofer-Gesellschaft (FhG) behält sich insbesondere alle Verbreitungs-, Ausstellungs-, Vorführungs-, Aufführungs- und Veröffentlichungsrechte an der Software vor.
Soweit nichts Abweichendes schriftlich vereinbart ist, ist der Kunde zu einer Nutzung der Software nur auf einer Hardware, d.h. an einem Bildschirmplatz an einem Ort und nur zu Testzwecken berechtigt (Einzelplatznutzung). Wechselt der Kunde die Hardware, muss er die Software vom Massenspeicher der bisher verwendeten Hardware löschen. Ein zeitgleiches Einspeichern, Vorrätighalten oder Benutzen auf mehr als nur einer Hardware ist unzulässig. Eine Nutzung der Software innerhalb eines Netzwerkes oder eines sonstigen Mehrstations-Rechnersystems ist nur zulässig, wenn damit nicht die Möglichkeit zeitgleicher Mehrfachnutzung der Software geschaffen wird. Die Software darf darüber hinaus nicht per Datenfernübertragung genutzt werden.
Der Kunde darf die Software nur vervielfältigen, sofern die Vervielfältigung für die Benutzung der Software notwendig ist. Zu den notwendigen Vervielfältigungen zählen die Installation der Software von dieser Website auf den Massenspeicher der eingesetzten Hardware, soweit dies vom Kopierschutz nicht verhindert wird, sowie das Laden der Software in den Arbeitsspeicher. Soweit dies zur Sicherung der künftigen vertragsgemäßen Benutzung der Software notwendig ist, darf der Kunde darüber hinaus eine Sicherungskopie der Software herstellen. Im Übrigen ist der Kunde zu Vervielfältigungen nicht berechtigt. Das gilt auch für die Vervielfältigung von Teilen der Software und für die – vollständige oder teilweise – Vervielfältigung der beigefügten Dokumentation.
Die Rückübersetzung des Programmcodes in andere Codeformen (Dekompilierung) sowie sonstige Arten der Rückerschließung der verschiedenen Herstellungsstufen der Software (Reverse Engineering ) sind nur im Rahmen des §69e Urheberrechtsgesetz zulässig.
Dem Kunden ist es nicht gestattet, die Software und die beigefügte Dokumentation zu Erwerbszwecken zu vermieten. Im Übrigen ist der Kunde zur Weitergabe der Software und der beigefügten Dokumentation nur berechtigt, wenn Dritte sich mit der Weitergeltung der Lizenzbedingungen dieser Ziff. 2. schriftlich einverstanden erklärt und der Kunde sämtliche Programmkopien dem Dritten übergibt oder löscht. Mit der Weitergabe erlischt das Recht des Kunden zur Programmnutzung. Der Kunde ist verpflichtet, FhG den Namen und die vollständige Anschrift des Dritten mitzuteilen.
Der Kunde ist nicht berechtigt, Urhebervermerke, Seriennummern sowie sonstige der Identifizierung dienende Merkmale der Software zu entfernen oder zu verändern.
3. Mängel
Die Software wird nur zu Testzwecken und darüber hinaus unentgeltlich zur Verfügung gestellt. FhG steht nicht für Sach- und/oder Rechtsmängel der Software ein. Dies gilt insbesondere auch bei nur unerheblicher Abweichung von der vereinbarten Beschaffenheit, bei nur unerheblicher Beeinträchtigung der Brauchbarkeit, bei natürlicher Abnutzung oder Schäden, die nach dem Gefahrübergang infolge fehlerhafter oder nachlässiger Behandlung, übermäßiger Beanspruchung, ungeeigneter Betriebsmittel oder die aufgrund besonderer äußerer Einflüsse entstehen, die nach dem Vertrag nicht vorausgesetzt sind. Werden vom Kunden unsachgemäße Änderungen vorgenommen, so bestehen für diese und die daraus entstehenden Folgen ebenfalls keine Mängelansprüche. Dies gilt nicht für Mängel, die FhG arglistig verschwiegen hat. FhG übernimmt keine Garantie gemäß § 443 BGB.
4. Schadensersatz
Schadens- und Aufwendungsersatzansprüche des Kunden (Im Folgenden: Schadensersatzansprüche) sind, gleich aus welchem Rechtsgrund, insbesondere wegen Verletzung von Pflichten aus dem Schuldverhältnis und aus unerlaubter Handlung, ausgeschlossen. Dies gilt nicht, soweit zwingend gehaftet wird, z.B. nach dem Produkthaftungsgesetz, in Fällen des Vorsatzes, der groben Fahrlässigkeit, wegen der Verletzung des Lebens, des Körpers oder der Gesundheit, wegen der Verletzung wesentlicher Vertragspflichten. Eine Änderung der Beweislast zum Nachteil des Kunden ist mit den vorstehenden Regelungen nicht verbunden. Der Schadensersatzanspruch für die Verletzung wesentlicher Vertragspflichten ist jedoch auf den vertragstypischen, vorhersehbaren Schaden begrenzt, soweit nicht Vorsatz oder grobe Fahrlässigkeit vorliegt oder wegen der Verletzung des Lebens, des Körpers oder der Gesundheit gehaftet wird.
Eine Änderung der Beweislast zum Nachteil des Kunden ist mit der vorstehenden Regelung nicht verbunden.
Schadensersatzansprüche gemäß Ziffer 4.1 verjähren in 12 Monaten. Dies gilt nicht für Mängel, die FhG arglistig verschwiegen hat.
5. Anwendbares Recht, Teilnichtigkeit
Auf einen Vertrag zwischen FhG und dem jeweiligen Kunden ist ausschließlich deutsches Recht unter Ausschluss des UN-Kaufrechts anwendbar.
Sollten einzelne Bestimmungen dieser Allgemeinen Geschäftsbedingungen unwirksam sein oder werden, bleibt die Wirksamkeit der Allgemeinen Geschäftsbedingungen im Übrigen unberührt. Anstelle der unwirksamen Bestimmungen treten Regeln, die denen am nächsten kommen, die die Vertragsparteien gewollt hätten, sofern sie den jeweiligen Umstand bedacht hätten. Dies gilt auch für Lücken dieser Allgemeinen Geschäftsbedingungen.
